Notion

Business premises and, to a lesser extent, the immediate surroundings of buildings, are protected by the propertiy provisions of the Penal Code. Individuals who trespass into a home that is not their own may be subject to criminal prosecution.

Freedom to form professional associations

The freedom to form professional associations guaranteed by the Federal Constitution allows individuals to join or not to join a trade union. They may also express their opinions and advertise the union they support.

Unions regularly ask the employer if they can enter the workplace to inform employees of their rights or to distribute leaflets. When the employer refuses, or during labor disputes such as a strike, unions may enter the company without the employer's consent or post themselves around the company to prevent access to the company.

In some situations, it could be an unlawful entry under the Penal Code.
