Criticizing your employer in the media

19 Dec, 2023 by Marianne Favre Moreillon

When a company is in the news because of a reorganization, its pay policy or workplace conflicts, the media are keen to hear what employees have to say. But beware: criticizing working conditions or an employer can be costly.

Employees owe their employer a duty of diligence and loyalty. They must refrain from any behavior likely to harm the employer's interests or reputation.

If an employee criticizes or disparages his or her employer in dealings with staff, customers, the media, the Internet or social networks, he or she is liable to immediate dismissal, depending on the circumstances. The same applies to public employment law.

This article covers the following topics:

  • duty of care and loyalty
