When an employee is disrespectful, threatening, or even violent with his or her employer, the continuation of the employment relationship is severely compromised. What are the risks?
If the employee's anger is attributable to a breach by the employer, the situation is more delicate. The employee must respect his/her duty of care and loyalty and behave respectfully towards his/her colleagues and superiors. In the event of a violation of personality, the employer is entitled to impose sanctions on the employee, depending on the degree of seriousness of the violation. In some situations, immediate dismissal may be justified under the circumstances, but this is not always the case. Moreover, it may happen that, following an altercation with his/her employer, the employee abruptly leaves the company's premises. Such behavior cannot be systematically considered as an abandonment of post.
